Please read these Terms of Service carefully before using Tingting POS. By using the App you agree to be bound by these terms. Questions? Email bangkeokhonsamai@gmail.com

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and Bangkeo Khonsamai ("Tingting POS", "we", "our", or "us") governing your access to and use of the Tingting POS mobile application ("the App").

By downloading, installing, or using the App, you confirm that you are at least 18 years of age and have the legal authority to enter into this agreement on behalf of any business you represent.

2. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the App solely for your own internal business purposes in accordance with these Terms.

This licence does not permit you to:

Sub-licence, sell, resell, or commercially exploit the App
Copy, modify, or create derivative works of the App
Reverse engineer, disassemble, or decompile any part of the App
Remove or alter any proprietary notices or labels in the App

3. Acceptable Use

You agree to use the App only for lawful purposes. You must not use the App to:

Process transactions for illegal goods, controlled substances, counterfeit products, or any product prohibited by Lao PDR law
Engage in fraud, money laundering, or any deceptive practices
Attempt to gain unauthorised access to other users' data or accounts
Upload malicious code, viruses, or disruptive content
Violate any applicable local, national, or international law or regulation
Harass, harm, or abuse staff members or customers recorded in the App

4. AI Assistant Disclaimer

Tingting POS includes an AI-powered assistant ("Tingting CFO AI") powered by third-party large language model APIs (Anthropic Claude, Google Gemini, DeepSeek).

Important: AI assistant responses are provided on a best-effort basis for informational purposes only. They do not constitute financial, legal, tax, or business advice. Always consult a qualified professional before making significant business decisions. Tingting POS accepts no liability for losses arising from reliance on AI assistant output.

By using the AI assistant, you acknowledge that your query text is transmitted to the relevant AI provider (see Privacy Policy, Section 5) and agree to that provider's terms of service.

5. Subscription & Payment

Tingting POS is currently provided free of charge during the beta/soft-launch phase. We reserve the right to introduce paid subscription tiers in the future.

If paid tiers are introduced:

You will receive at least 30 days' advance notice via in-app notification
Free tier features (if any) will be clearly communicated
You may cancel at any time; no refunds will be issued for partial billing periods unless required by law

6. Intellectual Property

All intellectual property rights in the App (including design, code, trademarks, and content) are owned by or licensed to Bangkeo Khonsamai / Tingting POS. Your use of the App does not transfer any IP rights to you.

Business data you create in the App (orders, products, customer records) remains your property. You grant us a limited licence to host and process that data to operate the App for you.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Tingting POS and its operator shall not be liable for:

Loss of profits, revenue, business, or anticipated savings
Loss of data beyond what we are obligated to retain under these Terms
Indirect, incidental, or consequential damages of any kind
Damages resulting from third-party service outages (Google Firebase, AI providers, etc.)

Our total liability to you for any claim under these Terms shall not exceed the amount you paid to use the App in the 12 months preceding the claim (currently zero during free beta).

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that the App will be error-free, uninterrupted, or free from harmful components. Use of the App is at your own risk.

9. Termination

9.1 Termination by You

You may stop using the App and delete your account at any time via Settings → Delete My Account. See our Privacy Policy for data retention details.

9.2 Termination by Us

We may suspend or terminate your access immediately if you:

Breach any provision of these Terms
Use the App for illegal or fraudulent activities
Endanger the security or stability of the platform

Upon termination, your right to use the App ceases immediately. We will process your data in accordance with our Privacy Policy.

10. Governing Law & Disputes

These Terms are governed by the laws of the Lao People's Democratic Republic. Any disputes arising out of or in connection with these Terms shall be resolved in the courts of Vientiane, Lao PDR.

We encourage you to contact us first at bangkeokhonsamai@gmail.com to resolve any dispute informally before initiating formal proceedings.

11. Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days' advance notice via in-app notification before the change takes effect.

Your continued use of the App after the effective date of any change constitutes your acceptance of the updated Terms. If you do not accept the updated Terms, you must stop using the App and delete your account.
